Broker Responsibility under TREC

In Texas, real estate sales agents are not permitted to practice independently. Every active sales agent must be sponsored by a licensed broker. Under TREC Rule §535.2, the sponsoring broker assumes complete regulatory responsibility for all real estate activities conducted by their sponsored sales agents.

Why This Rule Exists

This regulatory structure protects the Texas public by ensuring that experienced, designated brokers supervise sales agents. If a sales agent commits an infraction, TREC will investigate both the agent and the sponsoring broker to determine if there was a failure of supervision.

The Exam Trap

A common trap on the Texas state portion is believing that a sales agent can act as an independent contractor for tax purposes, and therefore the broker is not liable for their licensing infractions. While they are independent contractors for IRS purposes, for regulatory and licensing purposes, the broker has absolute liability for their authorized brokerage acts.
