Texas Law of Agency/Statutory Rule Explanation

IABS Form Delivery Methods

Last updated: |By Slate Azimuth Specialists
Direct Answer (BLUF)

The IABS form must be provided in the body of an email or as a link, not solely as an attachment.

Under TREC Rule §535.558, if delivering the Information About Brokerage Services (IABS) form by email, a link to the form must be located above the email signature block, in a readable 10-point font.

TREC Rule §535.558— Representation Disclosure Delivery

Statutory IABS Delivery Requirements in Texas

Providing the mandatory Information About Brokerage Services (IABS) form is not just about what you disclose, but how you disclose it. Sponsoring agents must strictly adhere to the delivery mechanisms mandated under TREC Rule §535.558 to avoid severe administrative fines.

Why This Rule Exists

Before these specific rules were written, agents would hide the IABS link in microscopic print at the bottom of automated emails, or attach it to a bulk PDF without informing the client. The strict rules ensure that consumers can easily find, read, and understand their agency options.

The Exam Trap

A common trap is the electronic signature or email delivery. If an agent delivers the IABS form by email:

  1. The link must be above the signature line.
  2. The link must use a minimum 10-point font.
  3. It must use the exact regulatory text: “Texas Real Estate Commission Information About Brokerage Services”.

Worked Texas Example

Scenario: Sales Agent Sarah in Houston puts a link to her IABS form in her email signature block in 8-point gray font, labeled “My IABS.” Sgreeing with a complaint, a TREC inspector reviews her emails. Outcome: Sarah has violated TREC Rule §535.558. She is fined $500 because the link was below the signature block, was too small, and did not use the required statutory title.
